Who it's for
The Assisted Living Waiver is a Medicaid home and community-based waiver for people who would otherwise need nursing home care. It lets you live in a licensed Personal Care Home-Assisted Living facility that is a Medicaid provider, and Medicaid pays for the services you get there. It is for people age 21 or older who meet clinical rules, based on a screening of daily activities, memory and thinking, behavior, and medical needs. You must qualify for Medicaid through SSI or with monthly income up to 300 percent of the SSI rate ($2,982 in 2026). Services include case management, personal care, homemaker services, attendant care, help with medicines, social and recreation programs, part-time skilled nursing, transportation, and an attendant call system. Medicaid pays for the services you get in the facility. You must need nursing home level of care and live in a facility that is approved for this waiver. There is a 5-year look-back on giving away assets. The Division of Medicaid makes the final decision.
